By using our products, services, or surfing Wedding Avenue content and website, you agree to our terms and conditions and understand our privacy policy.

COPYRIGHT:

All photographs, videography and other materials or media created by first/second/assistant photographer and/or videographer shall not be duplicated, edited, printed, or sold without company’s permission. All photography and/or videography work remains property of Wedding Avenue LLC. All rights reserved.

PROPERTY:

All images or photographic and videography material taken by Wedding Avenue photographer and videographer with or without logo remains property of Wedding Avenue. Using content including video and photo for personal purpose is permissible. Client agrees to pay separately for individual photos/videos before using it for any advertisement, promotional or any other reasons which results in generating revenue. In the event when client attempts to remove logo/edit without permission, he/she agrees to pay $40/photo penalty or remove the photo from the platform immediately. Otherwise, client agrees to pay $50/photo for using, promoting, advertising, marketing or any other purpose with/without permission. Personal use includes posting content to social media, printing photos or posting on client’s wedding website.

CHANGE OF DATE, TIME OR VENUE:

The company must be notified immediately of any changes in schedule (including date, time or location) at least two weeks prior to the scheduled date of event. Notification can be made by phone along with written notice sent via email for documentation. It is client’s responsibility to confirm all arrangements at least 7-14 days prior to the event. In the event of change of address or contract information (time, date, location, etc.) as listed, you must notify Wedding Avenue.

EXCLUSIVE PHOTOGRAPHER/VIDEOGRAPHER:

Wedding Avenue shall be the exclusive photographer(s) and videographer(s) retained by the client for the purpose of covering the event. Family and friends of the clients and other wedding vendors shall not interfere with the photographer’s and videographer’s duties. Guest will be asked to refrain from taking flash photographs at certain intervals of our services to ensure proper exposure of image. Client will not hold the company responsible for improper lighting caused by the venue, flash firing simultaneously in sync with our equipments. Client doesn’t hold the company liable for under/over expose images and clips.

CLASS ACTION WAIVER:

By using our services, client waives the rights to litigate in court or an arbitration proceeding any disputes as a class action, either from family, guests, client themselves, a member of a class or as a representative, or to act as a private attorney general.

PERMISSIONS:

It is client’s responsibility to schedule and receive permission to use various locations for photography, including the wedding, reception locations and any locations used during the day and must be inform to the photographer prior to the event booking.

MODEL RELEASE:

This agreement serves as a model release giving Wedding Avenue the irrevocable right to use the photographs and videos in all forms and in all media and in all manners, without any restriction as to changes or alterations, for advertising, newsletters, photographers’ portfolio, samples, self-promotions or for professional competition and review. A written note must be issued prior to the event for special circumstances for high profile individuals (not qualified for social media influencers), respecting privacy of the client or religious purposes.

HARASSMENT:

Ensuring the appropriate behavior of all guest and other persons at the wedding and other events covered by Photographer and Videographer shall be the responsibility of Client. In the event Photographer and Videographer experience any inappropriate, threatening, hostile or offensive behavior from any guest or other person at the wedding or other event(including, but not limited to, unwelcome sexual advances and verbal or physical conduct of a sexual nature) then following process shall be followed: first offense: a verbal warning will be issued to a family member of the client; second offense: the offending person will be required to leave the wedding or event; third offense: Photographer and Videographer will end wedding/event coverage immediately and leave the event. Photographer and Videographer shall be entitled to retain all monies paid here under and client agrees to relieve and hold Photographer and Videographer harmless as a result of incomplete wedding or event coverage.

NATURAL DISASTER:

If Wedding Avenue cannot perform this Agreement in whole or in part due to a fire or other casualty, acts of God or nature or terror, or other cause beyond the control of the parties or due to staff’s illness or injury, then company will return and all fees to the client(s) but shall have no further liability with respect to this Agreement. This limitation on liability shall also apply in the event that content and materials damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of Photographer and Videographer. Client(s) agree that an entire wedding cannot be replicated, reenacted or repeated for the purpose of re-shoot and limits Photographer’s liability to the amount paid under this contract.

RESPONSIBILITIES:

Unless agreed upon in advance, Wedding Avenue shall be the exclusive photographer and (or) videographer retained for the event. Photographer and(or) videographer may bring one assistant at his/her discretion. Other vendors as well as semiprofessional photographers, videographers or family members and guests must not abstract or interfere with the official coverage and are not allowed to take any still photos or capture footage during formal sessions. Wedding guests may take photos, but it is the responsibility of Client to prevent family and friends from interfering with Photographer’s and Videographer’s duties. Company is neither responsible nor liable for compromised coverage due to cause beyond their control such as other people’s camera or flash, the lateness of the bride, groom, family members and bridal party members or other principles, weather conditions, schedule complications, rendering of decorations, or restrictions of the venues or officiate. Photographer and Videographers are not responsible for existing backgrounds or lighting conditions which may negatively impact or restrict the coverage. Client agrees to confirm the schedule one-week prior to the event and to send the company a copy of the invitation prior to the wedding. Notification of any changes in schedule or location must be made in a timely manner. Changes can be made by phone with a follow-up email for documentation.

PUBLICITY:

Client refrain from negatively/positively speaking, writing or mentioning company’s work, service, and content including photography, videography, or behind the scene content. The company will follow up with you regarding your experience and request feedback in a timely manner.

PAYMENT FOR SERVICES:

A retainer fee of 50% from above packages is required to hold the date of your event. No date is reserved until a retainer is received. The balance of the complete package price must be paid at least 7 days prior to the event. No photography or videography coverage will take place and no rights are granted until timely payments are made in full.

EVENT CANCELLATION:

After booking your event via email, website, app or a call; client must notify at least 1-week of notice unless otherwise specified on fine prints, highlights or a contract. We reserve the right to retain 50% deposit.

FAILURE TO MAKE PAYMENT:

In case of an event where client is unable to pay the balance or full amount, Wedding Avenue will send the invoice to collection agency without any notification.
